1. Purpose and Scope
This Policy explains how New High Education governs the collection, use, protection, sharing, retention, and disposal of personal data across NHE AI Tutor, NHE Language Learner, our website, registration and login systems, learning portals, AI features, generated audio, downloads, subscriptions, and support services.
It applies to students, parents and guardians, teachers, administrators, Language Learners, staff, contractors, and service providers who process personal data for New High Education. It supports compliance with Ghana's Data Protection Act, 2012 (Act 843).
2. Our Data Protection Principles
We process personal data lawfully, fairly, and transparently. We collect only what is reasonably needed for clear educational, administrative, security, subscription, communication, and service-improvement purposes. We take reasonable steps to keep data accurate, secure, and no longer retained than necessary. Everyone with access to personal data is accountable for handling it properly.
3. Data We Process
For curriculum users, we may process names, contact details, IDs, school, class, subjects, roles, parent or guardian links, registration and approval records, learning activity, support messages, and account logs.
For Language Learners, we may process names, email addresses, mobile numbers, country, learning language, explanation or native language, learner level, learning goal, selected plan, marketing source, application notes, approval and payment status, renewal records, and locked-language settings.
We may also process prompts, questions, written answers, lesson selections, learning-path activity, vocabulary requests, placement responses, AI outputs, generated audio requests and files, download records, and speech-practice target text, submitted transcripts, scores, corrections, feedback, and drills.
Technical data may include device and browser information, IP address, login and security events, feature activity, usage counters, error reports, and performance logs.
4. How We Use Data
We use personal data to create and manage accounts; verify and approve access; provide curriculum and language-learning services; personalise lessons; generate AI responses, audio, feedback, and materials; record progress; administer subscriptions, free trials, renewals, payments, and usage limits; provide support; send necessary service messages; improve reliability and safety; and prevent fraud, abuse, unauthorised access, or other harmful activity.
Language Learner usage records are used to enforce the applicable daily free-trial allowance or monthly Plus and Pro allowance for AI coaching, audio generation, speech scoring, and vocabulary downloads.
5. Lawful Bases and Consent
We process data with consent where required, where processing is necessary to provide the service or manage an account, for legitimate educational, administrative, security, and operational purposes, to comply with legal obligations, or to protect the rights and safety of users and others.
Consent may be withdrawn, subject to processing already completed and other lawful reasons for retention. Withdrawal may prevent us from providing a feature or service.
6. Children and Student Data
Student and child data receive additional protection. We use it only for authorised educational, account-management, safety, administrative, and related lawful purposes. We do not sell student data or use it for unrelated advertising. Parent, guardian, school, or authorised administrator involvement may be required where appropriate.
7. AI, Audio, and Third Parties
We may use cloud hosting, databases, authentication, AI, text-to-speech, storage, communications, payment-confirmation, security, and monitoring providers. They may process only the information necessary to provide the relevant service for us or to you, subject to appropriate safeguards where applicable.
Users must not place unnecessary sensitive, confidential, or another person's personal information in prompts, transcripts, or learning materials. Generated audio and downloadable resources may be stored to provide account access, delivery, and support.
8. Access, Confidentiality, and Security
Access is role-based and limited to what a user needs. Students access their own records; parents or guardians access only approved linked records; teachers and administrators access information needed for authorised duties; and Language Learners access their own language-learning account and materials.
Staff, teachers, administrators, contractors, and service providers must keep data confidential. They must not access records out of curiosity, share data without authorisation, use data for personal gain, or copy records unnecessarily.
We use reasonable safeguards including authenticated access, role-based permissions, restricted administration, secure cloud infrastructure, encryption where appropriate, logging, monitoring, and access reviews. Suspected breaches must be reported immediately to New High Education.
9. Payments, Retention, and Deletion
We may retain plan, payment-reference, amount, status, and related account data needed to approve access, administer renewals, resolve disputes, prevent fraud, and maintain required records. We do not intentionally store Mobile Money PINs, bank passwords, or full payment credentials.
We retain data only for as long as needed for the stated purposes, active service, legal and educational records, security, disputes, or other lawful obligations. When no longer needed, we take reasonable steps to delete, anonymise, archive, or securely dispose of it.
10. Rights, Requests, and Complaints
Subject to applicable law, you may request access, correction, deletion where appropriate, restriction or objection to certain processing, withdrawal of consent, and an end to direct marketing. Requests must be sent to admin@newhigheducation.app. We may verify identity and authority before acting, especially for student records.
You may raise a concern with New High Education or the Data Protection Commission of Ghana. See our Privacy Policy for further information about data rights, international transfers, cookies, and contact details.
11. Updates and Responsibilities
We may update this Policy when services, technology, operational practices, or legal requirements change. Continued authorised use after publication of an update is subject to the updated Policy. Employees, teachers, administrators, and contractors must follow this Policy as a condition of access to New High Education systems and data.
